2.         Collection/Storage of Personal Data; Type/Purpose of Data Use

When you visit the website www.pecalaw.de, the browser on your device automatically sends information to the website server. This information is temporarily stored in a log file. The following information is recorded without your intervention and stored until it is automatically deleted:

  • IP address of the requesting computer;
  • date and time of access;
  • name and URL of the retrieved file;
  • website from which access is made (referrer URL);
  • the browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

The aforementioned data will be processed for the following purposes:

  • ensuring a smooth connection of the website;
  • ensuring comfortable use of the website;
  • evaluation of system security and stability as well as
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f of the General Data Protection Regulation (GDPR). The legitimate interest follows from the purposes listed above for data collection. Under no circumstances will the data collected be used for the purpose of drawing conclusions about your person (profiling).

3.         Passing on of Data

Your personal data will not be passed on to third parties for purposes other than those listed below. Your personal data will only be passed on to third parties if:

  • this is permitted by law and is required under Art. 6 para. 1 sentence 1 lit. b GDPR for the settlement of contractual relationships to which the person concerned is a party or for the implementation of pre-contractual measures with you;
  • in the event that a legal obligation exists for the transfer pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR,
  • the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data, and
  • express consent has been given pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR.

The data passed on may be used by the third party exclusively for the purposes mentioned. The attorney-client privilege remains unaffected. As far as it concerns data which are subject to the attorney-client privilege, a passing on to third parties only takes place in consultation with you.

5.         Rights of the Persons Concerned

You have the following information and intervention rights:

- the right to information according to Art. 15 GDPR: you have the right to request information about your personal data processed. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned duration of storage, the existence of a right to correction, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, unless these were collected from the person responsible for this website (see section 1 above), and the existence of automated decision-making including profiling and, if applicable, meaningful information on its details;

  • the right to rectification pursuant to Art. 16 GDPR: you have the right to request the immediate rectification of inaccurate or the completion of your stored personal data;
  • the right to cancellation pursuant to Art. 17 GDPR: you have the right to request the cancellation of your stored personal data, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • the right to restrict processing in accordance with Art. 18 GDPR: you have the right to request the restriction of the processing of your personal data if you dispute the accuracy of the data, if the processing is unlawful but you refuse to delete the data and if the data is no longer required, but if you need it to assert, exercise or defend legal claims or if you have filed an objection to the processing in accordance with Art. 21 GDPR;
  • the right to data transferability pursuant to Art. 20 GDPR: you have the right to receive your personal data that you have provided in a structured, current and machine-readable format or to request its transfer to another person responsible;
  • the right to revoke consent granted pursuant to Art. 7 para. 3 GDPR: you have the right to revoke your consent at any time vis-à-vis the person responsible for this website (see section 1 above). As a result, data processing based on this consent may no longer be continued in the future;
  • the right of appeal under Art. 77 GDPR: you have the right to complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or work or the office mentioned under section 1 above.

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this which arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented without specifying a particular situation.
